All items shown on this site are for general guidance only.
FLOWERS
Due to seasonal and local availability we cannot guarantee that the
content of your delivery will always match identically what is shown on this
site.
In the
interests of providing you with the best possible floral delivery we may substitute
one or more items. If there are particular flowers or colours that you would
prefer to be included or even excluded, then we will do
our utmost to meet your request.
GIFTS
Should an item be out of stock, a similar product of equal or greater value
may be sent, rather than disappoint and miss the intended delivery date.
Prices
All prices quoted include postage, packaging, delivery (as described below)
and VAT at the standard rate.
Delivery
Please see the delivery guidelines on our delivery information page. Please
ensure the correct address details are provided for the intended recipient
and contact
details in the event of any delivery problems. Evergreen cannot be held responsible
for orders being delayed by incomplete or incorrect information.
Should the recipient not be home we will attempt to deliver to a neighbour
or post a card through the letterbox informing them that a delivery has been
attempted.
Please ensure the correct address is provided for the recipient. If an attempted
delivery fails (such as the wrong address specified on the order), we reserve
the right to charge additional costs to re-deliver or to deduct the shipping
costs/product wastage/courier return fee from any refund if the order is subsequently
cancelled.
There may be delays in delivery where a third party is involved, such as delivery
to hospitals, hotels, offices and ships. In case of delivery to such locations,
the signature of any person authorised to accept delivery on behalf of the
organisation shall be accepted as proof of delivery.
Our liability for non-delivery of the products shall be limited to replacing
the product within reasonable time.
Shortages / Damages
All claims for Delivery Shortages or Damages must be reported to Evergreen
within 3 days of the delivery date.
Orders
You will be given clear instructions in how to complete the details required
on the order form. By clicking on the ‘Pay’ button on the order
form, you are consenting to be bound by these Terms and Conditions and those
appearing
anywhere on the Evergreen website and authorises Evergreen to take payment
for the item(s) ordered.
Full payment for all items purchased through this site is required before your
order can be despatched. We accept all major credit and debit cards with the
exception of Electron cards. All Credit Card details are taken securely using
PayPal. Evergreen reserve the right not to process an order if it is believed
that the credit
card transaction
may
have
been made
fraudulently.
Under such circumstances the customer will be contacted to obtain further information.
An email will automatically be sent confirming that your order has been received
and is being processed, please check this carefully. We will not consider ourselves
bound by a contract with you until we send you an acceptance e-mail.
Orders cannot be accepted from customers under the age of 18 years.
Complaints
At Evergreen we are fully committed to providing you with the best possible
gift delivery service. Evergreen will investigate your complaint and endeavour
to respond within five working days at non-seasonal times. (Christmas, Valentines
Day and Mothers Day may take longer). We will keep you informed throughout
the complete process and if we are satisfied that your complaint is genuine
a replacement
or refund will be given. This does not affect your statutory rights as a customer.
FLOWERS / BALLOONS / FRUIT BASKETS /
GOURMET HAMPERS / CHOCOLATES (PERISHABLE)
If you are dissatisfied with the service you have received please notify us
within 24 hours of delivery and retain the item concerned. Complaints on quality
cannot
be investigated if made later than 7 days following date of delivery. All these
items are perishable in nature and so cannot be returned under the distance
selling regulations.
TEDDY BEARS (NON PERISHABLE)
If any teddy bear delivered is faulty or damaged then it will be replaced by
either the same type of bear or one of similar value if it is no longer available
or a full refund will be given as long as the bear is returned in its original
packing within 30 days of purchase. If you are not happy with your choice of
teddy bear then a full refund will be given provided it is returned undamaged
and in its original packing within 30 days from the date of delivery.
Limitation of Liability
In no event will Evergreen be liable for any damages including, without limitation,
indirect or consequential damages, or any damages whatsoever arising from use
or loss of use, data, or profits, whether in action of contract, negligence
or other tortuous action, arising out of or in connection with the use of the
site. Under no circumstances whatsoever shall our liability exceed the invoice value of any goods or services provided.
Disclaimer
Evergreen does not warrant that the functions contained in the website will
be uninterrupted or error free, that defects will be corrected, or that this
site or the server that makes it available are free of viruses or bugs or represents
the full functionality, accuracy, reliability of the materials. This site and
the information, names, images, pictures, logos and icons regarding or relating
to Evergreen and its products and services (or to third party products and
services), is provided "as is" and on an "is available” basis
without any representation or endorsement made and without warranty of any
kind whether
express or implied, including but not limited to the implied warranties of
satisfactory quality, fitness for a particular purpose, non-infringement, compatibility,
security
and accuracy.
Privacy Policy
We are committed to protecting your privacy (in accordance with the Data Protection
Act 1998). W shall only use the information received from you for the purpose
of processing your order and to provide you with the best possible service.
We will never share your confidential information with anyone, and will not
e-mail
you in the future unless you have given us your consent. See Privacy Policy.
General
Evergreen reserves the right to supplement and amend the Terms and Conditions.
It is the responsibility of the customer to review the Terms and Conditions
when using the website. They shall be governed by English law and the parties
hereby
agree to submit themselves to the exclusive jurisdiction of the English Courts.
These terms and conditions do not affect your statutory rights.
